1023 Review & Expedited Process

group of business partners having a meetingTypically, 501c3 applications are processed according to the order by which they were received by the Internal Revenue Code (IRS). Within a few weeks of filing, you will receive a letter from the IRS stating that your 501c3 application has been received and is in process.  Keep this letter for your records, as it will contain the name and phone number of the agent responsible for your case.

Review Process: Upon receipt, exemption Applications submitted with the required user fee are separated into three groups: (1) those that can be processed immediately based on information submitted, (2) those that need additional information to be resolved, and (3) those that require additional development.

If your application falls in the first or second group, you will receive either your determination letter or a request for additional information, via phone, fax, or letter. If your application falls within the third group, you will be contacted once your application has been assigned to an EO specialist. If this occurs, contact RightTrac Consulting to walk you through the process on submitting requested document or documents immediately. Some types of applications must be assigned to specialized agents due to the issues involved and may take longer to process. In most cases (but not always), you will receive your tax-exempt status in around four months or so (3 to 6 months is the typical range). Here’s a link to the IRS website page that tells what month incoming 501c3 applications are being assigned to IRS agents for processing: http://www.irs.gov/Charities-&-Non-Profits/Where-Is-My-Exemption-Application

However, the IRS may Expedite the process in some cases. Expediting the process must be made in writing and can only be done if there is a compelling reason to do so, such as:

  • A newly established organization aiming to provide disaster relief to victims of emergencies
  • A pending grant, where failure to get the grant will negatively affect the organization’s operations
  • IRS errors have resulted in undue delays in handing out a determination letter

If you want your application to be expedited, RightTrac Consulting can help. We have the expertise and resources to help you expedite the process.
