Articles of Incorporation
The first step to the 501c3 process is to Incorporate in your state by filing Articles of Incorporation. Incorporation fees varies from state to state, ranging between $25 to $125. The time frames on receiving Incorporation can range from 1 day to 90 days, depending on the filing method and the state. To prevent delays with the 501c3 approval, Articles must include Dissolution clauses and the Purpose of the organization, in a specific language to qualify for the IRS 501c3 federal tax exemption.
Tax ID Number and Bylaws
The second step is to obtain a Tax Identification Number from the IRS. This can also be referred to as the EIN or FEIN. After obtaining your EIN, bylaws would have to be created. Bylaws are produced to set the management guidelines and rules, that is to be followed by the directors and organization. Obtaining an EIN is included in Plus and Premium packages. Bylaws are included in all RightTrac Consulting packages. There are no state or federal filling fees associated with obtaining an EIN.
IRS Form 1023
The third step is to complete and submit IRS Form 1023. Completing this form can be difficult and if not completed correctly, can result in delays on your approval. The IRS Form 1023 is submitted to the IRS along with the Articles of Incorporation (Articles of Formation) documents, EIN, Bylaws, Conflict of Interest Policy, and any additional schedules or supporting documents.
